Terms and Conditions of the Korea Foundation Cultural Center Membership Article 1 (Objectives): These terms and conditions stipulate membership qualifications and detailed information of using services contained at the Korea Foundation Cultural Center's (hereinafter referred to as the Center) Internet web site(http://www.kfcenter.or.kr). Article 2 (Definition) ¨ç The Center's web site is an on-line information center and community designed and operated by the KF Cultural Center. ¨è A user is an individual who accesses the Center's Internet web site and uses duly uses the resources in accordance with the provision. ¨é A member is an individual user who submits personal information in the given form and is approved by the Center. ¨ê An email address, registered at the Center's web site, shall be used to identify and allow access of the user. ¨ë An ID number means a combination of texts and numbers that is chosen by the user and approved by the Center to identify the user. ¨ì A password means a combination of texts and numbers decided by the user to have an access to members-only services and to protect the user's personal information. Article 3 (Effective date of and amendments to the provisions) ¨ç These terms and conditions shall go into effect by the time they are posted on the web site. Any major amendments to the terms and conditions, including rights and obligations of users, shall be announced in advance. ¨è Under reasonable circumstances, the Center may change the terms and of this site, and such amendments shall be noticed to users in advance. ¨é Agreeing to these terms means that a user shall visit the Center's web site on a regular basis and be aware of any changes in the provision. The Center shall not be responsible for any unfavorable situation incurred to the user not knowing the amendments. ¨ê Users may apply for withdrawal of membership if do not agree to the changed terms. In case members continue to use the Center's services 7 days after the new terms and conditions go into effect without expressing their opinion, it is considered that they agree to the change. Article 4 (Commencement of membership) ¨ç The agreement of membership goes into effect as the user agrees to terms and conditions and the Center approves the on-line registration. ¨è When turning in the online registration form, the user expresses his or her intention by clicking on the "I agree" button at the end of the terms and conditions. Article 5 (Membership) ¨ç One may choose to become either a full member or an associate member. ¨è No qualification is required to become an associate member. One must be over 18 years old to register as a full member. ¨é No membership fee is required for an associate member. Associate members are entitled to 1. receive invitations to exhibitions, lectures and seminars that are organized by the Korea Foundation Cultural Center(hereinafter referred to as the Center). 2. receive newsletters issued by the Center. 3. access members-only services on the Center's Internet web site. ¨ê Only associate members are allowed to register to become full members. One should visit the Center in person and deposit membership fee after showing an identification. The deposit fee is refundable when withdrawing the membership. Full members are entitled to 1. receive invitations to exhibitions, lectures and seminars that are organized by the Korea Foundation Cultural Center(hereafter referred to as the Center). 2. receive newsletters issued by the Center. 3. access members-only services on the Center's Internet web site. 4. rent printed materials and books from the Center's library. 5. apply to rent the Center's facilities, including seminar rooms. Full members will be given membership cards issued by the Center. Article 6 (Registration for Service Use) ¨ç One must provide personal information required by the Center to register as a member. ¨è Membership registration shall be done only with real names. The Center has the right to take measures to verify whether registrants have used their real name. ¨é Users who register with fake identification should be deprived of all rights and be subject to punishment by relevant laws. ¨ê The Center classifies its members by category and entitles each category with different level of access to its online services. Article 7 (Privacy Policy) ¨ç The Center collects the minimum information needed to provide services to members, and it asks for personal consents in case it needs additional information for identification. ¨è Pursuant to the privacy policy, the Center shall do its best to protect personal information provided by users. Relevant laws and the Center's privacy policy will be applied to protect personal information of the users. The Center, however, is not responsible for protecting users' privacy at the web sites that are hyper linked to the Center's homepage. Any information exposed due to mismanagement on users' part shall not be considered as responsibilities of the Center. Article 8 (Approval and limit of Users' Registration) ¨ç Pursuant to Article 6, the Center shall approve of service use by order of registration except that procedural or technical are in the way. ¨è The Center may decline request for registration in the following cases. 1. When the registration is made with fake ID or other individual's name. 2. When it is revealed that the personal information filled in the User's Registration Form is not true. 3. If the purpose of registration may disturb social order and traditional values. 4. When the user plans to use the service for negative purposes. 5. When the user plans to tap on the service for profit-making purposes. 6. If the registration is made in violation of the terms and conditions. ¨é The Center may reserve approval of registration for the following reasons to be resolved. 1. When the Center's facility is fully occupied. 2. When there is a technical problem with the web site operation. 3. Other situations where permission for using the service is impossible due to the Center's error. Article 9 (Grant of ID) ¨ç The Center may grant users with IDs in accordance with these terms and conditions. ¨è It is impossible to change one's ID in principle. If a person wants to change it for inevitable reasons, one must first withdraw membership and then re-register with a new ID. ¨é Under the consent of the user, one may use the same ID as the one being used for the Center's Internet web site. ¨ê All managerial responsibilities for ID and password are on the user, therefore, any responsibilities of loss or fraudulent use of the ID by a third party should be borne by the user. The Center is not responsible for any accidents that may arise due to mismanagement of ID and password. Article 10 (The KF Cultural Center's Obligations) ¨ç The Center, with an exception for the cases where there is any inevitable reasons, should be able to start providing service on the date the user wants to receive it. ¨è The Center is obliged to repair or restore if there are any damages to its facilities in order to provide continuous and stable services to its members. ¨é The Center announces and observes the privacy policies and takes necessary measurers technically in order to protect personal information. ¨ê The Center should take appropriate measures with no delay if its user file opinions and complaints that are considered to be objective and reasonable. In case that there are difficulties to correct it instantly, the Center should inform the user of the reason and the schedule. Article 11 (Members' Obligation) ¨ç Members are obliged to enter in real names and all information providing in registration or change personal information should be based upon facts. Individuals who are found to have used false information shall be deprived of membership and all rights. ¨è Members should observe the terms and conditions stipulated in these provisions and should reserve from any demeanors that might disturb the Center's operation or dishonor the Center's values. ¨é Members should notice without delay of any changes in address and contacts to the Center through appropriate procedures. ¨ê Members are responsible for any results incurred by mismanagement of IDs and passwords except for the cases that the Center takes responsibility as stipulated in relevant laws and privacy policies. ¨ë Members are banned to utilize the Center's services for profit-seeking business activities, and the Center shall not be responsible for any losses incurred by such activities. In case there is any loss on the part of the Center due to the member's unauthorized business activities, the member is responsible for compensating the loss. The Center may limit the individual's membership and use of service and through legal procedures request for compensation. ¨ì Members are not able to transfer, grant or provide their membership and rights as a collateral to a third party without the Center's approval. ¨í The Center should not infringe upon the Center's or a third party's intellectual properties. ¨î Members are banned from making the following demeanors. The Center may limit use of service or take appropriate measures if a member violates the regulation. 1. Entering false information when registering or changing personal information. 2. Using other person's user ID and password 3. Transacting user's ID with a third party 4. Pretending to be the Center's operational members, staff members or employees. 5. Hacking the Center's Internet server and modifying the information, partial or whole, 6. Damaging the service on purpose. 7. Duplicating the information achieved from the Center's service without prior concent and using it for publication, broadcasting, or providing it to a third party. 8. Distributing bulger information, texts, diagram, sounds or animation by posting them on the bulletin board. 9. Posting messages that are insulting or information containing character assassination. 10. Harassing or blackmailing other users; inflicting inconvenience or trouble to other users continuously. 11. Collecting and downloading other users' personal information without consent from the Center. 12. Making demeanors that are objectively considered to be connected to criminal activities. 13. Violating terms and conditions stipulated by the Center. 14. Other violation of relevant laws Article 12 (Time for Service Use) ¨ç The Internet service is available for 24 hours a day all around the year unless there is any special occasion in which provision of service is impossible due to operational or technical problems. The Center may temporarily suspend the service for checking, expanding or repairing the system on a designated time and date. Suspension of services should be noticed in advance through the Center's home page. ¨è The Center may decide to suspend all its services for checking, expanding and repairing the system with no prior notice. The Center may also halt its present services if it decides replacing it with all new services is appropriate. ¨é The Center may limit or halt its services, with reasons of national emergency, electricity shortage, disturbance in service facilities or explosive demand for the service. In this case, however, the Center should send out prior notice to its members and inform the reason and duration of service suspension.¨ê The Center may not be able to notice in advance if the service is suspended by reasons that are not controllable by the Center or by intentional assault or mistake on a third party. Article 13 (Management of Bulletin) The Center may delete, move or decline the messages or information posted on the bulletin board without prior notice in the following cases. 1. Any messages intended to insult or defame other members or the third party. 2. Any information distributing or providing linkage to smuts. 3. Messages encouraging illegal piracy or hacking. 4. Commercial advertisements. 5. Information that is objectively considered to be related with criminal activities. 6. Any contents that violates rights, including copyrights, of other users or a third party. 7. Messages that are discrepant from the Center's principles for bulletin operation or messages that are not appropriate for the purpose of the bulletin. 8. Other cases that are considered to be in violation of relevant laws. Article 14 (Copyright of Bulletin) ¨ç Users may post messages on the Center's bulletin if it doesn't violate the law of copyright protection or if the author has agreed to distribute the message through Internet web sites. ¨è By posting the messages on the Center's bulletin, users approve the Center of free use of the posted information. The Center may reprocess the data partially or wholly in any form, media, using any technology that is being used as of now or will be developed during the period of copyright ownership to use, duplicate, publish, translate or edit in other materials and to distribute worldwide. Posting the information also means that the contents may be accessed, downloaded and duplicated by other users. With the precondition listed above, the copyright owner holds all rights. ¨é If there is a loss on the part of copyright owner regarding the posted contents, users, not the Center, shall take all responsibilities. ¨ê If the Center decides that certain information posted by members is in the cases listed Article 13, the Center may delete or decline to post the information without prior notice. Article 15 (Provision of Information) ¨ç The Center may send information, via email or other means, any information that is considered to be needed for using the Center's services. ¨è The Center may request to provide additional personal information under the members' consent for purposes of improving service quality. Article 16 (Change of Contract and Cancellation) If a member wants to change contract of service use or cancel his or her membership, one must follow the necessary procedures using the appropriate forms included in the Center's web site. Article 17 (Provision of Exemption) ¨ç The Center is exempted from its responsibility to provide services to its members in force majeure including natural disaster and wars. ¨è The Center is exempted from its responsibility when it fails to provide services due to suspension in services of electricity or telecommunication. ¨é The Center is exempted from its responsibility for losses incurred due to repair, replacement, periodical checking and engineering works. ¨ê The Center is not responsible for suspension of service provision or losses incurred by a member's mistake. ¨ë The Center is not responsible for any losses incurred by computer errors of the user or lack of personal information or wrong email address. ¨ì The Center does not take any responsibility for losses incurred while using the information a member has obtained from the Center's Internet web site. The Center is not responsible for psychological damage inflicted by other members while using the Center's online service. ¨í The Center is not responsible for credibility or accuracy of the information posted by members. ¨î The Center is not obliged to mediate any disputes occurring among members ofthe Center or between a user and a third party, and it is exempted from any responsibility of compensation. ¨ï The Center has no responsibility for any loss that may incur due to free information it provides to its members. Article 19 (Jurisdiction and referring laws) ¨ç Any issues, that are not detailed in these terms and conditions, shall abide by the relevant laws of the Republic of Korea. ¨è Any legal conflicts and lawsuits, entailed by use of the web site, shall be dealt in the jurisdiction of where the headquarters of the Center is located. (Supplementary provision) Article 1 (Effective date) These terms and conditions shall go into effect as of July 25, 2005.
